Terms updated on May 27th, 2010
Following this message will be the new terms then there will be a point where it goes into old terms I will have a end ********************************* to the new terms

Advertising:
OurSafeHarbor does have 3 sister sites, Area-51-Emails, Dynamic-Mails and Email-Moneymaker (all sites .com) and as long as that will be the case it is not allowed to advertise OurSafeHarbor at the Sister Sites and v.v.

Part 1 - Responsibility of Affiliates:
Members from the no longer allowed countries who joined after May 7th, 2009, but before November 1st, 2009 will be paid as long as they stay active and follow the terms.
Members from the no longer allowed countries who joined after November 1st, 2009 can stay as a member and only redeem for ads as long as they stay active and follow the terms.

Part 5 - Upgrades:
Self-earnings / click requirement:
All affiliates with an upgrade must have 20% self-earnings to each $3.00 payout and need to click 150 links per month equally balanced in PTC's and eMails.
All affiliates with the free upgrade must have 10% self-earnings to each $3.00 payout and need to click 75 links per month equally balanced in PTC's and eMails.
If you do NOT click the required clicks your account will be fined $0.01 per month clicks are not met.
If this happens the first time, you will only get a warning message, the second and more times your account will be fined as mentioned above.

Part 6 - Affiliate Pages:
You may not promote your affiliate page at sites mentioned in our banlist. OurSafeHarbor do have the right to add a site to the banlist at any time.
When you are caught promoting your affiliate page at a site mentioned in our banlist: 1st & 2nd time - you will receive a message with the request to remove the promoting at that site within 2 days.
3rd time - you will receive a message with the request to remove the promoting at that site within 2 days and your affiliate page will be paused for 1 week.
4th time - you will receive a message with the request to remove the promoting at that site within 2 days and all your affiliate page earnings will be withdrawn.
5th time - you will receive a message that your affiliate page has been removed and will not be withdrawn.

When purchasing an affiliate page you will get 17 ads: 10x Text links, 5x $0.00015 PTC's, 1x Top Rotating Banners and 1x Bottom Rotating Banners.

Self-earnings / click requirement for affiliates with an affiliate page:

Part 7 - Paid to Promote:
Self-earnings / click requirement for affiliates using PTP Page:
Point_PTP4All: Self-earnings 10% of their total earnings in their account earned by clicking PTC and eMails.
You must login at least every month and click/read 75 PTC's and eMails per month equally balanced.
Members using this PTP and click less than 75 paid links per month, will be fined $0.01 per month clicks are not met.
If this happens the first time, you will only get a warning message, the second and more times your account will be fined as mentioned above.
Paid PTP:
Self-earnings 20% of their total earnings in their account earned by clicking PTC and eMails.
You must login at least every month and click/read 75 PTC's and eMails per month equally balanced.
Members using this PTP and click less than 75 paid links per month, will be fined $0.01 per month clicks are not met.
If this happens the first time, you will only get a warning message, the second and more times your account will be fined as mentioned above.

Part 9 - OurSafeHarbor Activity Requirement:
Upgraded members, members with an Affiliate Page and or using the PTP Feature as now mentioned under Part 5, 6 and 7.
Free members and members with the free upgrade 30 paid links every month equally balanced in PTC and eMails.
Members who have not clicked 30 paid links in a month will be suspended.

Part 15 - Payment:
At the time I took overOurSafeHarbor on the banners and homepage is mentioned $0.50 payout, while in the terms still is mentioned $3.00 payout.
To avoid misunderstandings: minimum payout is $3.00 - maximum payout is $6.00 and you must have met the click requirements / self earnings.

By signing up and actively using the OurSafeHarbor program you agree to all terms and conditions set forth in this agreement. OurSafeHarbor may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its affiliates. Affiliates will be informed of any and all changes to this policy via an e-mail to their primary contact e-mail address provided upon signing up with OurSafeHarbor. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the OurSafeHarbor program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Affiliates:
You must be 18 years of age or older to participate in this program. Our program is open to both US and International affiliates and is void where prohibited by local governing laws.

As of November 1st, 2009. We will only be allowing members from the following countries. Australia, Austria, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Iceland, Ireland, Italy, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom, United States.

Members who are not from the above countries but joined before November 1st, 2009 can stay a member as long as they stay active and follow the terms.

As Off May 7, 2009 I won't allow any signups from: Afghanistan, Albania, Angola, Belarus, Bosnia and Herzegovina, Burma, Cameroon, Central African Republic, Chad, China, Cote d'Ivoire, Cuba, Democratic Republic of the Congo, East Timor, Equatorial Guinea, Haiti, Georgia, India, Iran, Iraq, Hong Kong, Lebanon, Liberia, Libya, Macedonia, North Korea, Poland, Russia, Rwanda, Serbia and Montenegro (including Kosovo), Sierra Leone, Singapore, South Korea, Sudan , Syria , Taiwan, Thailand, Vietnam & Zimbabwe. Members from the above countries, who joined before May 7, 2009 can only redeem for ads!

You agree to and must use your own name and e-mail address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different e-mail addresses. Your computer must not be shared with another individual that has an existing OurSafeHarbor account.

You will use your e-mail address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Info." link.
You are solely responsible for any and all use of your OurSafeHarbor account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by OurSafeHarbor be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you used when signing up with OurSafeHarbor. You agree to receive e-mail advertising from OurSafeHarbor limited to no more than 200 per day.

In the event your e-mail account on file becomes closed or blocked to messages from OurSafeHarbor, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

Interests:
We have several "Bad" interest, (I cheat, I don't understand English etc) this assists us in finding the members that can not understand English. If your account is found to have one of these interests selected your account will be suspended.
If you have selected the Interest "Take my money (I will)" you will see you earnings disappear on the 1st of each month, just as long as you unselect the interest. You won't get these earnings back!
All members must select two interests otherwise they won't receive any paid emails. Those keywords are "I agree with the terms" and "I read the terms".
The interest "I own a PTR/PTC" needs verification. Easiest is to contact me with the site names you own. Otherwise I will send you a message on the 1st of each month asking to send me a mail with the site names you own. If you don't contact me with your site name(s) it will be considered as a cheat interest, and your account is at risk for suspension. It is fine if you don't want me to know which sites you own, simple don't select the interest "I own a PTR/PTC".

Cheat Links:
Our advertisers are paying for you to read their ads that they have purchased. In order for us to have a good honest site and members, knowing they are reading there ads and emails, we must include Cheat Links. These are found in emails and on the site itself and have a negative value. You will have them say Don't click this link, Delete this ad, etc to be warned not to read these. This is to insure that we have members understanding English and NOT blind clicking. Once you are caught clicking the Cheat Links more than 3 times, your account will be Deleted. There are no second chances and you will lose all of your earnings and referrals.
It can happen you have clicked a cheat link by mistake, contact me within 1 hour after clicking the cheat link and I will refund the lost money. I will only do that if you contact me within 1 hour after clicking the cheat link!

English Tests:
Members must be able to read and understand English. Every month there will be at least 1 admin message with a question, story or just a word you must pick. When members pick the wrong answer or word their account will be flagged, 3 wrong picks and your account will be deleted!

Upgrades:
Members may upgrade at anytime. However, are not required to upgrade. We will not force members to upgrade in order to get paid. When ever you choose to upgrade you understand that upgrades are non refundable, even if we decide to close the site or change the upgrades! Every upgrade has monthly ads and free referral rotation. Monthly ads will not be carried over to the next month! It is your own responsibility to submit your monthly ads on time!
You are not allowed to sell your Upgraded ads. Members caught selling their upgraded ads will be deleted immediately.

Affiliate Pages:
All Affiliates may purchase an Affiliate Page if they like to have one. You will get 20 ads with your affiliate page, 10 sponsor links, 5 .015c PTCs, 3 Top Rotating Banners and 2 Bottom Rotating Banners. The sponsor links may only be a Site Name and Link. Affiliate pages may be promoted almost every where including PTP rotators, there are no Tiers! Autosurfs and Manual Surfs are not allowed, any one caught promoting their Affiliate Page in Autosurfs or Manual Surfs will donate 50% of their Affiliate Page earnings to OurSafeHarbor.
Affiliate Pages are non-Refundable! If your account is deleted your affiliate page will also be deleted.
Members using an Affiliate Page must click at least 75 paid links per month. If you do NOT click the required clicks your account will be fined $0.05 per month clicks are not met.

Paid To Promote:
Paid To Promote is an additional feature to the PTR for upgraded members only. You must be active in the PTR by clicking at least 75 paid links per month to use the PTP feature. If you are caught abusing the PTP your PTP will be suspended and your account is at risk of termination. You may NOT just run the PTP link and cash out!

Members using the PTP and click less than 75 paid links per month, will be suspended for the PTP for the next month. Click counters are reset at the first of each month, you can also view current click counters in your member area.

It is each member's responsibility to check our approved sites list prior to advertising their PTP Links. If the site you wish to advertise with is not on our approved list, contact us with the exact URL of the website in and we will check and add it if the site is sustainable. Our approved list is different than the one at the right side of the site!!!

I also recommend that you check your PTP statistics often. If your link receives too many proxy or invalid traffic, your link will automatically be suspended by the system. Once your link receives 40% or more in invalid traffic or Proxy traffic, the system will AUTOMATICALLY suspend your PTP Link. It is the member's responsibility to monitor their link and avoid link suspension!

Vacation Mode:
When you put your account on vacation you also need to take it off when you come back. Accounts that are on vacation or inactive do not get payouts requested or randomly. If you plan on being away over 30 days then you need to contact me and let me know so that your account will be flagged and it does not get deleted. Any account that has been set on vacation for 30 days will be deleted if it is not activated within 15 days after those 30 days have passed.

OurSafeHarbor Activity Requirement:
All members must be active, I rather have a small active member base than a huge inactive member base.
Therefore all members, free and upgraded, must click 30 paid links every month. That is 1 paid link ever day.
Members who have not clicked 30 paid links in a month will be suspended.

OurSafeHarbor About Suspension:
Members will be suspended for 2 reasons only.
Reason 1 - The member have selected one of the cheat interests.
Reason 2 - The member have not clicked 30 paid links in a month.
All accounts will be checked and suspended on the 1st of each month. Suspended members will then have a month time to contact me about their account. On the 1st of the next month all suspended accounts will be deleted.

OurSafeHarbor About Cheaters:
It won't be a surprise but I do not allow Cheaters!
Cheaters are members who do not follow the terms.
Members with incomplete or false information are cheaters.
Members who are not from one of the allowed countries are cheaters.
Members who have multiple accounts are cheaters.
Members using any kind of clicking software are cheaters.
Clicking cheat links is cheating, if you have clicked 3 cheat links your account will be deleted.
Cheaters will be deleted on a daily base, there are no second changes.

OurSafeHarbor Mistakes can happen:
Just like you I am only human. It is normal that we make mistakes. If you see an advertisement with a link value more than 1c and there is no line which says it is an extra valued surprise ad. Don't hesitate to contact me. For these kind of mistakes I will do a rollback on the earnings, if you where honest to let me know you might get a surprise.

Relationship of the Parties:
You and OurSafeHarbor are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and OurSafeHarbor. You understand that you do not have authority to make or accept any offers or make any representations on behalf of OurSafeHarbor. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
OurSafeHarbor will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or OurSafeHarbor program, even if OurSafeHarbor has been advised of the possibility of such damages. Furthermore, OurSafeHarbor aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by OurSafeHarbor. Members may earn by referring new affiliates to the OurSafeHarbor program. Members will earn a percentage of advertising revenues collected by OurSafeHarbor.

OurSafeHarbor will pay members when their balance reaches the minimum payout rate set by OurSafeHarbor. ($3.00) Once the member has reached payout they will see an option to request payout. Payments will be made within 30 days or a reasonable time after.

Important to know:
Before you request payout be sure you have selected the keywords/interests "I agree with the terms" and "I read the terms".
Your account is in "good standings" meaning all fields are filled with real and complete details, no abcd or ggggff in any field!
You have clicked 30 paid links.
If you have not selected the required keywords/interests, or your account is not in "good standings", or you have not clicked the 30 paid links you payout request will be canceled.

If your payout request is canceled, check your account info, if you can't find anything contact me. Do NOT request payment again before you know why it is been canceled! If I need to cancel your payout request 3 times for the same reasons, than the 3rd time will be considered as a donation!
If your payout request is been gone without being paid it is better to contact me, than request it again!

Members will only be paid a maximum of $10 per month.
If your account reach $10. You will be paid to the account on file! If there is no account on file I will contact you about it.
If you are saving money for an upgrade you need to contact me about it.

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with OurSafeHarbor and may result in legal prosecution. OurSafeHarbor strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. OurSafeHarbor may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. OurSafeHarbor will file charges for recovery of any earnings received from multiple sign-ups.

OurSafeHarbor Respects Your Privacy

Information Collected:
OurSafeHarborhas created this privacy statement in order to demonstrate our firm commitment to privacy. OurSafeHarboruses your IP address to help diagnose problems with our server, and to administer our Web site. Your IP address is used to gather broad demographic information. OurSafeHarboruses cookies to deliver content specific to your interests, to save your password so you don't have to reenter it each time you visit our site, and for other purposes. OurSafeHarbor's registration form requires users to give us contact information (like their name, address, and e-mail address). OurSafeHarboruses member contact information from the registration form to send the member information about our company and e-mail advertisements.

Affiliates may opt-out of receiving future mailings; see the choice/opt-out section below. Demographic and profile data is also collected at our site. We use this data to tailor the visitor's experience at our site, showing them content that we think they might be interested in, and displaying the content according to their preferences. We collect personal off-line information for the sole purpose of paying affiliates for earnings from our program. This site contains links to other sites. OurSafeHarboris not responsible for the privacy practices or the content of such Web sites. OurSafeHarborUses a sign-up form for new affiliates and advertisers. We collect visitor's contact information (like their e-mail address, address, and name). The member's contact information is used to get in touch with the member when necessary. Users may opt-out of receiving future mailings; see the choice/opt-out section below.

Public Forums:
OurSafeHarbor, in the future, may make chat rooms, forums, message boards, and/or news groups available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

Security:
OurSafeHarborhas security measures in place to protect the loss, misuse and alteration of the information under our control.

Children's Guidelines:
We do not collect online contact information without prior parental consent or parental notification, which will include an opportunity for the parent to prevent use of the information and participation in the activity. Without prior parental consent, online information will only be used to respond directly to the child's request and will not be used for other purposes without prior parental consent. We do not collect personally identifiable off-line contact information without prior parental consent. We do not distribute to third parties any personally identifiable information. We do not give the ability to publicly post or otherwise distribute personally identifiable contact information. We do not entice by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity.

Choice/Opt-Out:
OurSafeHarborprovides users the opportunity to opt-out of receiving communications from us at the point where we request information about the visitor. OurSafeHarborgives users the following options for removing their information from our database to not receive future communications or to no longer receive our service. Log in to your account and click the "User Account Info." Link. At the bottom of the page you will find the option to "Cancel Account". You may also Contact Us and request your affiliateship to be canceled at anytime.
